AMANA FEST

SPONSORSHIP & HOSTING AGREEMENT
 

1. PURPOSE OF AGREEMENT

The purpose of this Agreement is to authorize the Sponsor/Host to sponsor and host an Amana Fest event under the brand name, system, structure, and operational guidelines established by Amanacare Ministries.

Amana Fest is a community outreach initiative providing free vehicle oil change and basic vehicle inspection assistance to the elderly, disabled, low-income individuals, and families in need.
 

2. APPLICATION AND APPROVAL

2.1 Any church, nonprofit organization, or business seeking to sponsor or host an Amana Fest event must complete and submit an official Amana Fest application.
 

2.2 Approval is at the sole discretion of the Service Provider.

2.3 No organization may advertise, represent, or host an event under the Amana Fest name without written approval from the Service Provider.
 

3. RESPONSIBILITIES OF THE SERVICE PROVIDER

The Service Provider agrees to the following:

3.1 Free Oil Change and Inspection Services

The Service Provider shall:

• Provide oil change and basic vehicle inspection services free of charge during the approved Amana Fest event.

• Supply trained personnel and/or volunteers to perform the services.

• Provide guidance regarding safety procedures and operational standards.

• Determine, at its sole discretion, the scope and limitations of services provided at each event.

The Sponsor/Host acknowledges that vehicle owners must provide their own motor oil and oil filter unless otherwise arranged in advance.

3.2 Optional Training of Sponsor/Host

In certain cases, and at the sole discretion of the Service Provider, the Service Provider may:

• Train the Sponsor/Host’s volunteers or designated representatives to perform oil change and inspection services using the Amana Fest system.

• Provide instructional materials, operational procedures, and safety guidance.

• Authorize the Sponsor/Host to independently conduct future Amana Fest events under continued written approval.

Such training does not create an employment relationship, partnership, joint venture, or agency relationship between the Parties.

The Service Provider reserves the right to revoke training authorization if standards, safety, or brand integrity are not maintained.
 

4. RESPONSIBILITIES OF THE SPONSOR/HOST

Upon approval, the Sponsor/Host agrees to:

4.1 Facility and Location

• Provide a safe, accessible, and suitable location, including an empty parking lot or outdoor space adequate to host the event.

• Ensure compliance with all local zoning, fire, safety, and city ordinances in Springfield, Missouri, and the State of Missouri.

• Obtain all required permits.

4.2 Volunteers

• Provide a minimum of five (5) volunteers.

• Ensure volunteers act professionally and follow safety instructions provided by the Service Provider.

• If trained to perform oil change services, ensure volunteers strictly follow the Service Provider’s system and safety protocols.

4.3 Hospitality

• Prepare and provide coffee, donuts, refreshments, or giveaways at their discretion.

• Ensure compliance with local health and food safety regulations.

4.4 Compliance with System

• Follow all operational, branding, safety, and instructional guidelines provided by the Service Provider.

• Use only approved logos and promotional materials.

• Not modify or misrepresent the Amana Fest system.
   

5. BRAND USE AND INTELLECTUAL PROPERTY

5.1 The name “Amana Fest,” its logos, systems, processes, and materials are the exclusive property of Amanacare Ministries.

5.2 Sponsor/Host is granted limited, revocable, non-transferable permission to use the brand solely for the approved event.

5.3 The Sponsor/Host shall not reproduce, distribute, or commercialize the system outside the scope of this Agreement.
 

6. NO EMPLOYMENT OR PARTNERSHIP

Nothing in this Agreement shall be construed as creating:

• An employer-employee relationship,

• A partnership,

• A joint venture,

• Or a franchise arrangement.

Each Party remains an independent entity responsible for its own actions and obligations.
 

7. COMPLIANCE WITH LAW

The Sponsor/Host agrees to:

• Obey all applicable federal, state, and local laws.

• Comply with Missouri state regulations governing charitable and nonprofit activities.

• Ensure services are conducted safely and lawfully.

This Agreement shall be governed by and construed under the laws of the State of Missouri.
 

8. DONATIONS

8.1 Sponsoring and hosting Amana Fest does not require a mandatory fee.

8.2 Voluntary donations to Amanacare Ministries are welcomed to support and expand the ministry.

8.3 Donations are charitable contributions and are not required for approval unless agreed in writing.
 

9. LIABILITY WAIVER AND INDEMNIFICATION

9.1 The Sponsor/Host acknowledges that vehicle maintenance services involve inherent risks.

9.2 By signing this Agreement, the Sponsor/Host agrees that Amanacare Ministries, its officers, directors, volunteers, trainers, and representatives shall not be held liable for:

• Mechanical failures,

• Vehicle damage,

• Personal injury,

• Property damage,

• Losses arising from the event.

9.3 The Sponsor/Host agrees to indemnify, defend, and hold harmless the Service Provider from any claims, liabilities, damages, or legal actions arising from:

• Use of the event location,

• Actions of volunteers,

• Failure to follow safety procedures,

• Independent execution of services after training,

• Violation of laws or regulations.

9.4 The Sponsor/Host is strongly encouraged to maintain general liability insurance coverage for the event.
 

10. TERMINATION

10.1 Either Party may terminate this Agreement in writing.

10.2 The Service Provider may immediately revoke authorization if:

• Safety standards are not maintained,

• The system is misused,

• The brand is misrepresented,

• Laws are violated.

Upon termination, all use of the Amana Fest name must cease immediately.
 

11. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Parties and supersedes all prior discussions.

Any modifications must be in writing and signed by both Parties.
 

12. AGREEMENT

By filling out and submitting the application below, the Parties acknowledge that they have read, understood, and agree to all terms, including the Disclaimer and Liability Provisions.
